These Terms of Service ("Terms") govern your use of zealoussites.com and the services provided by Zealous Sites ("we," "us," or "our"). By using our website or engaging us for a project, you agree to these Terms. If you don't agree, please don't use the site or our services.

A signed project proposal or statement of work, where one exists, takes precedence over these Terms for that engagement.

Zealous Sites provides web design, development, content, and ongoing support services. The specific deliverables, timeline, and price for any project are defined in a written proposal agreed by both parties. We reserve the right to decline or discontinue work that falls outside an agreed scope or violates these Terms.

Estimates produced by our online calculator are planning tools based on market-average effort. They are not binding quotes.

• A signed proposal sets a fixed project price for the agreed scope
• If the scope doesn't change, the price doesn't change, with no surprise charges
• New requests beyond the agreed scope are quoted separately before work begins
• Proposals are valid for 30 days unless stated otherwise

Unless your proposal states otherwise:

• A deposit is due before work begins, with the balance billed at agreed milestones
• Invoices are payable within 14 days of issue
• Ongoing hosting and care plans are billed monthly or annually in advance
• Late or missed payments may pause work and, after notice, incur reasonable fees

A great website is a partnership. To keep your project on track, you agree to:

• Provide content, assets, and feedback in a timely manner
• Designate a point of contact empowered to approve work
• Ensure you own or have rights to all materials you supply to us
• Maintain your own backups of any content you provide

Delays in providing materials or approvals may affect the project timeline.

Upon final payment, ownership of the custom deliverables we create for your project transfers to you, except for third-party components and our pre-existing tools or frameworks, which are licensed to you for use within your site.

We may showcase non-confidential work in our portfolio and case studies unless you ask us in writing not to.

Each project includes a defined number of revision rounds as stated in your proposal. Additional revisions, or changes that alter the agreed scope, are quoted and approved before we proceed. This protects both the timeline and the fixed price.

We stand behind our work and will correct defects in our deliverables reported within 30 days of launch at no charge. Beyond that, services and the website are provided "as is." We don't warrant that the site will be uninterrupted or error-free, or guarantee specific business outcomes such as traffic or revenue.

To the fullest extent permitted by law, Zealous Sites' total liability arising from a project is limited to the amount you paid us for that project. We are not liable for indirect, incidental, or consequential damages, including lost profits or data, arising from the use of our website or services.

Either party may end an engagement with written notice. If you terminate, you remain responsible for work completed and costs incurred up to that point. We may suspend or end services for non-payment or breach of these Terms. Sections on intellectual property, payment owed, and liability survive termination.

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Any disputes will be handled in the state or federal courts located in Ohio.

We may update these Terms from time to time. When we do, we'll revise the "last updated" date above. Continued use of our website or services after changes take effect means you accept the revised Terms.
